コウペンちゃん公式WEBSHOP コウペンちゃんはなまるストア（以下「本サイト」という）をご利用いただく前に、本利用規約（本規約のほかご利用ガイドその他当社が定める一切の規約、ルール等をいいます。以下同じ。）をよくお読みください。
お客様には、本利用規約に同意いただいた上で、株式会社グレイ・パーカー・サービス（以下「当社」という）が提供する本サイトをご利用いただきます。本利用規約に同意いただけない場合はご利用いただくことができません。
【ご利用について】
お客様は、本利用規約（変更後のものを含みます）を了承し、同意の意思表示をした上で、本サイトのご利用を開始し、または継続利用いただくものとします。
【著作権について】
本サイトのすべての内容・情報などに関する著作権は、当社または当社に対し使用を許諾した第三者に帰属します。私的利用の範囲を超えた、複製、頒布、販売、公表等の行為を禁止します。
【本利用規約の変更について】
当社は、次の場合において、お客様への事前の通知・承諾なしに、本利用規約を変更できるものとします。この場合、当社は、お客様に対し、本サイトに掲示ないしメールアドレスに通知する等の方法により、変更後の新利用規約の内容とその効力発生時期をお知らせするものとします。
・お客様の一般の利益に適合する変更である場合
・本サイトの目的に反せずかつ合理的な変更である場合
上記に関わらず、当社は、お客様に対し、改めて、変更後の新利用規約への同意を求める場合があります。
本利用規約が変更された後の本サイトのご利用については、変更後の新利用規約が適用されるものとします。
【本サイトの内容変更・中止等について】
当社は、事前通知および承諾なく、本サイトの内容変更・中止・停止をすることができるものとします。なお、当社は本サイトの変更・中止・停止によって生じるいかなる損害について一切責任を負わないものとします。
【売買契約の成立】
お客様が本サイトにおいてご注文を行うことは、売買契約の申込みになります。ご注文完了後に、当社システムからご注文完了メールを自動送信しますが、これはお客様のご注文手続が完了したことをお知らせする趣旨に留まるものであり、売買契約の承諾を意味しません。当社において、後述する契約のお断り・取消し等に関する事由に該当しないと判断した上で商品を出荷した時点でお客様の申込みが承諾され売買契約が成立するものとします。なお、契約の成立後も、当社は、後述する契約のお断り・取消し等に関する事由に該当すると判断した場合において、契約の取消し・解除をさせて頂くことができます。
また、お客様が注文手続きを完了した場合であっても、決済の受付の先後等により、購入した商品が売り切れとなる場合があります。この場合、当社は、受領済みの代金がある場合はこれを返金しますが、当該商品等の引渡義務を負わず、また、お客様に発生した一切の損害について責任を負いません。
【所有権の移転について】
お客様が購入された商品の所有権は、当社より発送した商品がお客様の指定配送先に到着した時点で移転します。
【契約のお断り・取消し等について】
当社は、以下の事由の一つにお客様が該当した場合、お客様のご注文完了後や当社がご注文完了メールを送信した後でも契約の締結をお断りすることがあるほか、当社が商品を発送して契約が成立した後でも、契約を取り消しまたは解除することができるものとします。
(１) クレジットカード会社および決済会社による審査等の結果、承認・決済が受けられなかった場合
(２) お客様の個人情報等に虚偽の事実が認められた場合
(３) ご注文の商品が完売、または長期にわたり入荷時期が未定の場合
(４) ご注文数量限定商品に対し、所定の数量を超えたご注文をいただいた場合
(５) 本利用規約、その他当社の規約や法令に対する違反が認められた場合
(６) 本サイトに掲載された価格その他の商品情報または販売条件等に誤りがあった場合
(７) 上記各号の一つに準ずる事由が認められた場合（過去のお客様と当社との取引において、上記各号の一つにお客様が該当していた場合を含みます。）、その他、当社においてご注文に応じられないと判断した場合
【キャンセルについて】
お客様による商品申込みのキャンセルは、当社がご注文完了メールを送信した後は、応じられません。お客様のインターネット環境の都合によりご注文完了メールが未達であっても応じられません。
商品をお受け取りいただけず当店へ返送された場合
当社から商品を発送後、お客様が商品をお受け取りにならず当店に返送された場合（受取拒否、不在による保管期間経過、宛先不明の場合を含みますが、これに限りません。）、当社からお客様の登録メールアドレスに通知をいたします。
商品の再発送をご希望される場合には、メール通知後1ヶ月以内に当社からのメールに返信にてご連絡をお願いいたします。なお、再発送は送料着払いにて出荷させていただきます。
当社からのメール通知後1ヶ月間を経過してもなおご返信ならびに受け取りがなされない場合には、お客様の登録メールアドレスに通知することによりご注文をキャンセル扱いとした上で、下記の費用をお客様負担として処理させていただきます。商品代金を事前にお支払いいただいていた場合は、お客様負担分を控除した残額があればその分につきご返金の処理をさせていただきます。
配送料
※料金は当社が定める地域別配送料に準じます。詳細はご利用ガイド内、「配送について」をご確認ください。
※送料無料注文の場合も同様に請求させていただきます。
※再発送が複数回にわたる場合、回数分の配送料を請求させていただきます。
※配送会社の規約等により復路の送料が別途発生する場合はその分は追加でお客様負担となります。
注文された商品に関して発生した手数料等の実費（ラッピング手数料、各種サービス手数料を含みますが、これに限りません。）
【返品・交換について】
商品の返品・交換には、初期不良以外応じられません。
商品ではない販促品(ノベルティ)、外装段ボールや包装資材の不良、破損などの交換はお受けできません。
商品お届け後、万が一不備・不良がございましたら、商品到着後7日以内に、コウペンちゃんはなまるストアカスタマーセンターへお問い合わせフォームよりご連絡ください。不良品は原則交換での対応となります。但し交換在庫が無いもの、交換が不適当と当社が判断する場合は返金するものとします。
返品をお受けできない事例
(1)長期保管などによる、商品到着日より対応期間を過ぎてからの初期不良
(2)事前連絡なしに返品された商品
(3)お客様が使用した後に傷や破損が生じた商品
(4)ご購入者様以外からの交換依頼
(5)オークションサイト等正規ルート以外で購入されたとき
(6)本サイト外の店舗（常設店、実店舗、インターネット店舗を含みますが、これに限りません。）で購入されたとき
(7)製造上の特性によるものである場合
【転売・不適切行為について】
営利目的での購入および転売は禁止します。 当社が営利目的・不正行為・不適切であると判断する行為（例えば、購入上限がある商品の個人または集団による反復注文、個人利用とは認め難い大量注文・大量キャンセル、反復または継続的な商品の転売を含み、これらに限られません。）をお客様またはお客様から商品を入手するなどした第三者が行った場合、また、お客様に商品の受取り拒否、長期の不在・音信不通その他の不審行為または営業妨害行為等があった場合は、当社の判断により売買契約の取消し、解除、将来のご購入のお断り、その他適切な処置をとることができるものとします。これらの場合、お客様または第三者に損害が発生したとしても、当社はいかなる責任も負わないものとします。
【配達について】
一部商品を除いて、在庫がある商品は購入日から７営業日以内に、予約商品は出荷予定日から7営業日以内に配送いたします。なお、「営業日」とは、当社休業日（土日祝日・年末年始・夏季休業・棚卸・その他）以外の日をいいます。
天候、自然災害、停電、システムトラブル、事件・事故その他何らかの事由により配達が遅延することや、ご指定の配達希望日時にお届けできないことがあります。これらの場合にお客様または第三者に発生した損害について、当社は、いかなる責任も負わないものとします。
【ご注文の配送地域について】
日本国外への発送は受け付けておりません。
【会員登録に関して】
(1)会員情報の登録
会員情報の登録を希望されるお客様は、本規約を承諾していただいた上で、当社が別途指定する手続に従って会員情報を登録していただきます。
なお、会員に登録をしたことのみをもって、いかなる法的権利を付与されるものでもありません。
(2)変更の届出
氏名、住所、電話番号、その他当社に届出ている内容に変更が生じた場合には、速やかに当社所定の方法にて変更の届出をするものとします。
(3)譲渡等の禁止
お客様は、本サイトの会員の地位および本サイトの利用によって得た権利を、第三者に譲渡（相続等包括譲渡を含みます）、売買または名義変更し、貸与しまたは使用させ、担保に供する等の行為はできないものとします。
(4)会員による会員情報の取消し
お客様が、会員情報を取消す場合には、所定の方法にて当社に届け出るものとします。
(5)当社による会員情報の取消し
会員情報を登録されたお客様が以下の何れかに該当する場合、当社は、事前に通知することなく、直ちに当該お客様の会員情報登録を取り消すことができるものとします。また、当社が前述の措置をとったことで、本サイトを利用できなくなり、これにより当該お客様または第三者に損害が発生したとしても、当社は一切の責任を負いません。
・当社への申告、届出内容に虚偽があった場合
・決済手段として当該お客様が届出たクレジットカードが、クレジット会社による利用契約の解除その他の理由により、利用が認められなくなった場合
・料金等の支払債務の履行遅延または不履行があった場合
・電話、FAX、Eメールその他の手段によっても、お客様情報を登録されたお客様との連絡が取れなくなった場合
・本規約に違反した場合
・当社がお客様の死亡を認識した場合
・その他、不適切と当社が判断した場合
その他、当社が不適当と判断する行為また、その理由につきましてはお答えいたしかねますのであらかじめご了承ください。
(6)会員IDおよびパスワードの管理責任
会員IDおよびパスワードが大切なものであることを認識し、会員IDおよびパスワードの管理については、お客様が一切の責任を負うものとします。また、会員IDおよびパスワードを第三者に譲渡、売買または名義変更し、貸与しまたは使用させ、担保に供する等してはならないものとします。
(7)禁止事項
会員情報を登録されるお客様は、以下の行為を行ってはならないものとします。
・ご利用の際に虚偽の登録内容を申請する行為
・購入を優位に進めるため意図的に複数のアカウントを申請する行為
・本サイトの運営を妨げ、その他当社の提供するサービスに支障をきたすおそれのある行為
・クレジットカードを不正使用して本サイトを利用する行為
・会員IDおよびパスワードを不正に使用する行為
・他のお客様、第三者もしくは当社に迷惑、不利益もしくは損害を与える行為、またはそれらのおそれのある行為
・他のお客様、第三者もしくは当社の著作権、プライバシーその他の権利を侵害する行為、またはそれらのおそれのある行為
・公序良俗に反する行為その他法令に違反する行為、またはそれらのおそれのある行為
【個人情報の保護について】
別途掲載する「個人情報保護ポリシー」に同意の上、本サイトを利用するものとします。
【認証について】
本サイトは、個人情報保護のため、信頼性が高いとされるインターネット上の暗号通信技術SSL（Secure Socket Layer）を採用しています。ただし、当社はその安全性を保証するものではなく、万一、当社の帰責事由なくお客様の個人情報の漏洩等の事故が起こった場合、当社および各クレジットカード会社は責任を負いません。
【メールの削除等について】
当社は、当社または本サイトに関する誹謗、中傷、または本利用規約に違背する内容のメールを受信した場合は、何ら通知・返信等をすることなく当該メールを削除できるものとします。
【免責】
当社は、本サイトの利用または利用不能により、お客様、お客様の関係者もしくは第三者等に生じた損害について、本利用規約・その他の規定等に明示的に定める場合または当社の故意または重過失により損害が発生した場合を除いて、いかなる責任も負いません。
【合意管轄裁判所について】
本サイトに関して当社とお客様との間で生じた紛争の管轄裁判所は、東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所とします。
【準拠法について】
本利用規約の解釈、適用については、日本国法を準拠法とします。
